Marchi Collettivi e di Certificazione

Following the recent changes of the Italian Code of Intellectual Property, the two figures of the Collective trademark and the Certification trademark have been distinguished. Within 23.03.2020 it will be mandatory to convert the Collective marks already deposited in one or the other form (collective or certificatiin), under penalty of forfeiture.

A conversion request must be filed to the Italian Patent Office (UIBM) with a consequent impact on the duration of the title, which will remain of 10 years, but will start from the conversion date. Along with the application the Regulation of the mark must be filed again.

In cases where a renewal date for a trademark falls before the 23.03.2020, it is mandatory to file a conversion request within the renewal timeframe. The IT PTO will require an additinal official fee for conversion procedure.
